OUR VIOLATION SYSTEM

Impark manages parking lots on behalf of the lot owners, and each parking lot is private property. The signs at our parking facilities list the terms and conditions on which we offer parking. The driver of a vehicle parked on one of our lots accepts these terms and conditions.

We issue violation notices on vehicles:

  • not displaying valid parking receipts or passes
  • otherwise improperly parked

We do so because in addition to being entitled to receive payment for the parking space provided, we also need to ensure that there are a sufficient number of stalls available for paying customers.

PATROL

Many of our lots are equipped with unattended receipt dispensers, which results in an honour system of pay parking. Using hand-held computers, our patrol staff:

  • regularly inspect each lot to monitor compliance
  • issue notices to parked vehicles failing to display valid proof of payment
  • determine if registered owners have any overdue violations

Some significant violations that may result in removal of the vehicle from the lot (towing) are as follows:

  • overdue violation notices
  • blocking another vehicle
  • parking in a disabled stall without displaying a valid disabled pass

PAYMENTS AND INQUIRIES

The rates for violations are posted on the lot signage. If a violation is paid within a certain time frame, a reduced rate is offered.

There are several ways to make a payment, including on-line at www.impark.com.

We also have a number of Customer Service Representatives available to answer questions and handle disputes.

Collections

If a violation is not paid within the time indicated on the notice, it is referred to a collection agency for further action, and additional costs and interest (as permitted by provincial debt collection legislation) may be added.

If the collection agency is unable to recover the amount owing, we may take further legal action to do so.

YOUR CONTRACT WITH US

On June 26, 2000, the Canadian Federal Court of Appeal released a decision confirming that a person who parks on one of our lots is entering into a contract with us, regardless of whether the required parking fee is paid.

One of the terms of the contract is that if the required parking fee is not paid at the time the vehicle is parked, then you agree to pay the increased rate indicated on the sign, which is the violation notice amount.

The Court decision states that:

  • the terms and conditions of the contract are as set out on the signs posted at the entrance to the lot
  • the fee for not paying is the increased amount indicated on the sign (the violation notice amount)
  • This increased amount is a debt owing to Imperial Parking under the law of contract

VIOLATION NOTICE DISPUTES

A customer wishing to dispute a violation notice can contact us by:

  • telephone
  • letter

Contact information is listed on each violation notice, follow-up statement and in the local telephone directory.

Our Customer Service Representatives (CSRs) can access our computerized records to review:

  • the details of your violation notice
  • all previous unpaid notices
  • the rates and regulations of the parking facility at which the notice was issued

Depending on the nature of the dispute, the CSR can:

  • uphold the violation for the full amount
  • reduce the amount owing
  • cancel the violation notice
  • issue a refund (if appropriate)

The exact course of action for each type of dispute we receive is codified to ensure that each staff member treats every customer equally. All Impark and collection company staff must adhere to our dispute resolution standards.

Receiving a debt collection notice in the mail or a telephone call at home can be a distressing event. It is never our intention to annoy our patrons by issuing and following up on violation notices. Rather, we believe that like any business, we are entitled to be paid for the services provided. As an alternative to towing, our violation notices allow us to be flexible when the situation requires it.
